दिल्ली की सामूहिक बलात्कार की घटना पर आज वरिष्ठ लेखिका मृदुला गर्ग का यह लेख- जानकी पुल.

हमारे समाज में महिलाओं के साथ इस तरह के जघन्य अपराधों की एक परंपरा रही है. ये अलग बात है कि पहले पीड़ित और उनके परिजन शिकायत दर्ज कराने से डरते थे. अभी भी एक हद तक यह डर बरकरार है. 16 दिसंबर को दिल्ली में एक युवती के साथ हुए सामूहिक बलात्कार के बारे में जिस पहलू पर बात होनी चाहिए, कोई नहीं कर रहा है.
एक दुष्कर्म वह होता है, जिसमें किसी पीड़ित को एक आदमी दुष्कर्म का शिकार बनाता है. दूसरा होता है, सामूहिक बलात्कार. सामूहिक बलात्कार ज्यादा बड़ा अपराध है, क्योंकि इसे कई लोग मिल कर अंजाम देते हैं. यह अचानक नहीं घटित होता. यह एक तरह से सोच समझ कर की जाने वाली हत्या की तरह है. हत्या दो तरह से होती है. एक गैरइरादतन, दूसरी इरादतन. इस अपराध को इरादतन की गयी हत्या के समकक्ष माना जाना चाहिए. जहां तक मेरी जानकारी है, सामूहिक बलात्कार अन्य किसी देश में नहीं, सिर्फ हिंदुस्तान में होता है.
हमें देखना होगा कि आखिर हमारी मानसिकता में ऐसा क्या है, जो हमें ऐसी हिंसा के लिए उकसाता है. गांव में दलित स्त्रियों के साथ इस तरह की हिंसा आये दिन होती है. लेकिन हम शहर में रहने वालों तक ऐसी घटनाएं पहुंच ही नहीं पातीं. वहां 24 घंटे के खबरिया चैनल नहीं हैं. अगर खबर किसी तरह से बाहर आती भी है, तो दबा दी जाती है. लेकिन दुराचार की घटनाएं तो हैं ही. हां गांव में शहरों की तरह सामूहिक बलात्कार नहीं होते. शहर में पांच-छह के समूह में निकले लड़कों को सड़क पर अकेली लड़की दिख जाती है. ऐसे में उनके लिए इस तरह के अपराध को अंजाम देना आसान हो जाता है. मैं समझती हूं कि यह जीते जी एक लड़की की हत्या है. यह एक योजनाबद्ध हिंसा है. बलात्कार के लिए निर्धारित सजा इसके लिए बहुत कम है. इसकी सजा सोच समझ कर की गयी हत्या के बराबर होनी चाहिए. यह घटना भी रेयरेस्ट ऑफ द रेयर है. इसमें फांसी की सजा होनी चाहिए. इस मामले में पीड़ित लड़की के साथ सामूहिक बलात्कार तो हुआ ही है. उसे नृशंस ढंग से मारा गया है. उसके शरीर के कई हिस्सों में गहरी चोट है. इसलिए इसे हत्या ही माना जाना चाहिए. यह हत्या से किसी भी लिहाज में कमतर नहीं है. वह लड़की पिछले आठ दिन से जिंदगी और मौत से जूझ रही है. उसके शरीर और मन पर इतने गहरे घाव हैं जिन्हें शायद कभी नहीं भरा जा सकेगा. छह आदमी मिलकर जब एक लड़की पर जानलेवा प्रहार करें, उसके साथ बारी-बारी से बलात्कार करें, तो इसे एक नियोजित ढंग से की गयी हत्या के अलावा और क्या माना जा सकता है! यह वैसा ही है कि आप किसी को पहले जानबूझकर यातना दें, फिर उसकी हत्या कर दें. यंत्रणा देना और हत्या करना दोनों अपराध है. इस मामले में दोनों अपराध की धारा के तहत सजा होनी चाहिए.
ऐसा नहीं है कि इस तरह के अपराध महिलाओं के साथ घर से बाहर निकलने के कारण हो रहे हैं. वे सड़क पर, मेट्रो, बसों और दफ्तरों में जिस तरह से असुरक्षित हैं, घर की चारदीवारी के भीतर भी उनकी लगभग वही स्थिति है. घर के भीतर सामूहिक बलात्कार नहीं होते पर एकल पुरुष द्वारा आसानी से घरों में मौजूद महिला को शिकार बनाया जाता है. दरअसल, औरत का शोषण करने की अरसे से चली आ रही मानसिकता समाज के स्वाभाव में शामिल हो गयी है. देश को आजाद हुए छह दशक से अधिक समय बीत चुका है. लेकिन आज भी सरकार, पुलिस और समाज महिलाओं के प्रति पूरी तरह से संवेदनहीन बने हुए हैं. सरकार भले ही कानून बना देती है महिलाओं के हित में. लेकिन उसका सही ढंग से पालन हो, इसके प्रति वह कभी भी गंभीर नहीं नजर आती. पुलिस का भी यही हाल है. हमारे यहां थाने का माहौल और पुलिस का व्यवहार दोनों इस तरह के हैं कि पीड़ित को रिपोर्ट दर्ज कराने से डर लगता है या इसके लिए संघर्ष करना पड़ता है. पुलिस आसानी से उसकी एफआइआर नहीं लिखती. समाज पीड़ित लड़की के साथ नहीं खड़ा होता.
यह घटना राजधानी में हुई है, इसलिए इसकी बात हो रही है. लेकिन रोज ही सुदूर राज्यों, कस्बों और शहरों में औरतें दुष्कर्म का शिकार हो रही हैं. यह हमारी एक विकलांग मानसिकता को प्रदर्शित करता है. इसके लिए जब तक कानून में सख्तसजा का प्रावधान नहीं होगा, तब तक ऐसे अपराध नहीं रुकेंगे. मानसिकता बदलना भी जरूरी है. लेकिन इसका पहला समाधान सख्त कानून है. हालांकि सिर्फ सख्त कानून बना भर देने से काम नहीं चलेगा. उसका पालन भी होना चाहिए. साथ ही ऐसे पुलिस अधिकारी और कर्मचारी जो पीड़ित की रिपोर्ट दर्ज करने में आनाकानी करते हैं, उसे अपमानित करते हैं और दोषियों को संरक्षण देते हैं, उनके खिलाफ भी बिना देर किये कार्रवाई की जरूरत है. लेकिन बदलाव की उम्मीद तब और धुंधली हो जाती है जब राजनेता ऐसे मामलों में संवेदनहीन हो जाते हैं. ऐसी घटनाओं के बाद महिलाओं पर ही उल्टा टिप्पणी करते हैं. राजनीति में तो ऐसे भी कई लोग शामिल हैं जिन पर महिला अपराध के मामले दर्ज हैं.
